In August of 2023, Valdeacourt Farms requested that two parcels of land on Hurricane Creek Road at the junction of U.S. 35 be rezoned from Rural Residential to Commercial High Density.
The Putnam County Planning Commission held a hearing and recommended the rezoning as requested by Valdeacourt Farms. M. L. Reed, who resides on Hurricane Creek Road opposite one parcel and adjacent to another, objected. When the Putnam County Commission held a hearing on the matter, it denied the rezoning request. Valdaecourt Farms filed a suit in circuit court which would require the commission to approve the zoning. The court granted a motion made on behalf of M. L. Reed to be part of the proceedings. After the court heard dispositive motions from Valdaecourt and Reed, the court scheduled the matter for trial, which date was not set. M. L. Reed and Valdeacourt agreed upon a settlement which would reclassify Parcel 50.8 from R-R to C-2, with a 50-foot setback along Hurricane Creek Road. The northerly portion of Parcel 51 would be reclassified from R-R to C-2, with the southerly portion of the parcel remaining R-R. As a result of the agreement, M. L. Reed will withdraw his claim for relief and Valdeacourt will withdraw his complaint against the commission.
County Attorney Larry Frye, who represented the commission, said that he believed the judge wanted a settlement of agreement rather than a trial. The commission voted to approve the settlement agreement, and future action by the court will determine the outcome of the rezoning request.
